  • HOA's Get Destroyed on July 1st as new laws go into effect. The Homeowner Bill of Rights changes everything for those living in an HOA neighborhood. Governor Ron DeSantis signed HB 1203 which reduces what a homeowners association can do to the homeowner living within the community. HB 1203 as bee referred to as the homeowner bill of rights effectively reducing overreach.

    We lived in an out-of-control HOA community. The final straw was when the HOA decided that homeowners were only allowed to leave their garage doors open for 15 minutes. This was a community of acreage properties (1-2 acre lots) so we all had riding mowers/tractors & lots of other equipment to schlep in & out of our garages to maintain our properties. We all revolted & threw out the HOA board.

      @@TheRealLivingWithLisa Not that hard. You open the door, remove the vehicle, then close it. They obviously put a time limit of it so people don't leave them open all day. 15 minutes is an arbitary limit, but it is more than enough time to do what you need to do while keeping the doors closed normally, and if you are going to have a rule like this you need to set a number for it to be legal. This is actually a rule that probably would still be allowed under tne new law since the garage is very likely visible from the street.
      Some people just like to complain.

Apparently most of that community thought the 15 minute rule was ridiculous to have gotten rid of the Board. Since you think 15 minutes is real cool, I hope you practice what you preach and have your neighbors time you.

      @kenw.4539 Bylaw amendments have to be voted in, the board does not do that. So, if such a rule existed, the majority of owners thought it a good thing.
      Simply electing a new board won't change the bylaws. It does not matter who is on the board, bylaws require the majority of owners to vote any change to them. If the bylaw was not changed by the owners, the new board would still have an obligation to enforce it.
      15 minutes is an arbitary nominal value for convenience. The bylaw intent probably was that garage doors should be closed, but obviously have to be open at some point in order to use the garage. Legally, to enforce such a rule they have to put a value on how long it can be open, and it seems that 15 minutes was what they came up with. Long enough to do what you need to do when removing or inserting something into the garage, but short enough so that the closed door condition intended by the bylaw could be achieved. It is not like someone is going to be standing there with a stopwatch, but if you left the door open all day you would probably get fined as the intent of the bylaw is that the doors should normally be kept closed other than when it is necessary to use the garage
      It is pretty common sense, but some people will get their nickers in a knot and obsess with the nominal time period because they just have to have something to complain about. They will come up with incredibly dumb arguments such as "15 minutes is silly" and ignore the intent behind the bylaw. People are unreasonable like that unfortunately.

    When I bought this house that I'm in was built such that I could put a nice boat on the side of my house. I put a big American flag pole out front and I three ham radio antennas in my backyard. There is no way I could live in an HOA. My neighbors have never complained. I do have a big yard. That helps.

    A friend was president of a condo HOA in another state. He said a resident busted a hole in the roof without asking permission, to put a rooftop garden up there. When the HOA found out about it, they sentenced him to death. The HOA president said it would be better just to fine him the amount of money it costs to repair the roof. That's what they did. The offender fixed the roof at his expense, and soon thereafter passed way from natural causes.

    This bill does NOT go far enough. I like to live in a nice clean neighborhoods but there has to be certain particularities about your place. Represent who you are and believe in which is not easy in a hoa. I have a condo in sth fl ready to be put for sale. I will never ever buy any propery in an association complex. It has been years of suffering. Its like living in a comunist country. No freedom. Being watched being harassed. Never again!

      They need to include in the bill , that HOA can’t increase once yoy bought your house . These is the most important issues because many home owner can’t handle those high HOA , consequently’ they have to sell theirs house/apt.

      @@charmingbeautytv4712 Never happen, but perhaps a limit on yearly increase like the Property Taxes are set up. Costs go up so locking the dues to the initial amount is not reasonable. You could require a vote of 66% (or some other more than 50% number) of the owners to increase them.

    New legislation is needed in Tallahassee to address the inequity between those paying HOA fees and the towns that collect the property tax. HOA's pay for their own refuse removal. Well a credit should be given to the owner of that property for tax owed to the town. All the services provided by the HOA vs the town need to be calculated and deducted from the property tax owed to the town. Towns provide very little service to the HOA's. HOA's are being double taxed. That's why I would not buy into a HOA community. Thanks for the update Lisa!!

      Your property tax is to pay for services up the border of the development. Past that point and it becomes private property and the residents have to deal with the connection.

      HOAs don't pay for garbage collection. You must live in a really weird situation because in Florida, the counties or cities manage garbage collection.

      @@parajerry They contract the city to do it, or they contract a private company. HOA developments are private property and the city won't provide services on private property unless they are paid. If your HOA comes to an agreement with the city, they will do it, but it is not free and will be included in your dues. The same thing applies to any service that crosses the property line. Your HOA is responsible for the service on your side of the property line, not the city. The city will provide service up to the property line, but not beyond it.
      I live in a condo. The city does do garbage collection, but only on public roads and only for detached homes. We have to hire contractors to pick up our garbage, the city does not do it. That includes regular garbage and recyclables.

    Family law in Florida sucks I haven’t got to see my 2 year old son in 6months the cops keep telling me it’s a civil matter even though my ex is a known drug user who’s been arrested for filing false police reports.

    I suffer from Emotional/Stress related Epilepsy and the HOA in my building has put me in the hospital due to harassment I had 5 seizures was hospitalized 7 days. Yes she is being sued

    I like an HOA, i do not want to see overgrown grass, cars on grass, people that leave garbage cans all over the place, people are slobs and i do not want to live around it. Even when i rented i took care of it. Clothes lines ridiculous, i like manicured property, I do not have an issue with HOA rules 🤷‍♀️

      Most people have no issue with those rules. It's when the rules or the board goes overboard and creates new rules or just starts acting outside its authority. Telling you what color curtains you can have, no pickup trucks in the driveway, you have the wrong flowers in your beds...etc... Count yourself lucky if you haven't been the victim of an out of control HOA. Not all are out of control, but eventually, all will be. A certain kind of person always makes their way onto HOA boards. They are the exact WRONG type of person that should be in charge of, or in control of anyone else or their property. (See definition of 'Karens')

      Can't stand those rules, will never live in an HOA, I want to be able to keep a couple dozen project cars in my backyard without issue. It's my property, and I'll be damned if I let anyone tell me what I can and can't do with it! Like, if I have 3 dozen project cars in my backyard, and you have to peer over the fence to see them, that's a you problem, NOT a me problem

    CONSULTANTS REPORT ON CASH RESERVES, AND ANNUAL FINANCIAL AUDIT REPORT SHOULD BE IN THE HANDS OF EVERY OWNER, AT ALL TIMES, NOT JUST IN THE HANDS OF ONE PERSON (TREASURER), TO KNOW WHERE EXACTLY YOUR MONEY IS BEING USED. AGREE?

    We just bought recently a condominium in a HOA community in Florida. Was just told my husband can’t park his Ford transit van overnight. Pick up trucks, vans, motorcycles not allowed. Does this law applies to Condominiums owners?

    I know of some lovely vintage trailer parks in our area that do not have rules ,maybe take a look to see if you would could be happier in a place that has no rules seem to have alot of availability to accommodate people who don't like rules....go lucky !!!

    3. Sometimes, the president of the HOA is the developer who can not be voted out until the last unit is sold. Salary: ±c. $100 with full benefits for a very part-time job.
    3A. Said pres. hires a management company to do the actual work. The pres. of that company is usually a close relative (usually the spouse or child) paid around $80k.
    -< How about a law that for each house a developer builds in an HOA, said developer must build one that is not?
    >Your argument is that this violates the contractor's rights. That is, of course, true. But a mandatory, non-negotiable HOA agreement is definitely an adhesionary contract. There is NOT equal bargaining power.

    Your right. Communities that have been around for decades or board members are the ones more problematic. A good question is : how a homeowner can enforce the new common sense rules ? Do people need to faced the expensive lawyery involved or just complain in court.? Please bring some light on this

      HOA board members are now required to take 4 to 8 hours of Continuing education classes concerning the laws, authority, and limitations of HOAs. No longer can a board member claim ignorance,...if they step out of line, you can go after them legally. Because of the required training, and therefore ease of proving they knew their actions were unlawful, I suspect a whole new class of contingency lawyers will pop-up to assist homeowners with enforcing their rights.

    I personally like HOA...MY Problem is the people running them..my neighbor has slowly started to crash as the younger generations have slowly began, don't tell me what to do attitude...I personally ask them why they chose the neighbor ,answer was, it is so well maintained !!! Now it's starting to look like a parking lot, Christmas lights up all year,boats parked in driveway and unkempt lawns... so what do you do.....yea i know move.....some people simply should not live in HOA neighborhoods, they knew moving in what they were getting into ..so i thought ...

      He did put into effect a program where you can harden your home to better prepare it for a hurricane and this would help reduce the policy cost. It's a 10K grant you can apply for. Unfortunately, corporations ( insurance companies) are not willing to take risk anymore... this means, they are not willing to "RISK PROFIT" in the event of a catastrophic event. So they are charging a bunch to insure each of us....

      An HOA is recorded into the county clerk of courts as "deed restrictions". Even if a developer is still in control of a community they are required to record these restrictions in to the county records... BUT, this does not mean the developer has turned over the community. Usually when a developer completes construction they turn the community over to a board of directors who then controls the HOA. I am not familiar with the intricacies of The Villages HOA status. The developer could still be in control... I just don't know.

    Recently I had to sell a condo exactly due to the excess of regulations and to many people that have nothing to do in their live except take care of other people´s life. I was a nightmare, we were always afraid of being doing something wrong. I see with good eyes the new Florida´s legislation, hope will make live more confortable.

    Our HOA is ran by a company that is hours away. Not run by residents at all. How is that allowed? Never seen them do a single thing or ever come here. Thing is, we have opposite problem and our neighborhood is a free for all of un own yards, dead trees and trash.

      You are talking about the management company. They are employed by the HOA, not the other way around. If you have issues with services, talk to the board (ie your neighbors) and get them to resolve the issue.
      Management companies will do what they are contracted to do. They work for you. If you need something additional done, have the board contract for those additional services.

      Our HOA is run organically. Which means we have no HOA management company. We hire a general manager who is the senior employee of the HOA. Our 110 employees that do the golf course and common grounds maintenance, accounting, insurance, benefit administration, and other administrative functions are direct employee's of the HOA. We do contract out the gate and restaurant. Our HOA is well run with millions in cash reserves and when we do repairs we pay cash for everything. We have an internal audit community that makes sure each department spends it's money the way it is suppose to. It can be done with a good HOA.

      @ltcmoose2001 You probably have an upscale community. Most of the problems seem to be in middle class or blue collar HOAs, and I think the issue there is that the people who end up on the boards in places like that have no management experience, something that is much less likely to happen in upscale HOAs. They also tend to have residents with limited disposable incomes, who are much less likely to approve expenditures. As a result they frequently make poor choices and their developments suffer for it.
      These sorts of people are simply not suited for home ownership. You see similar issues when they own discrete homes outside of an HOA as well, those are the houses that are poorly maintained and rotting away, you see them all over the place in lower middle class/blue collar neighborhoods.

    Glad to see homeowner's rights being restored. I lived in an HOA one time in the late 90s. I'll never do it again. IMO they do nothing that a group of part time concerned citizens could do themselves.

    Mandarin Lakes HOA are the worse. They charge the monthly fee of $350 but they close the pool for half of the summer. The pool had been closed since February into today that it was inspected by the County and it was re-opened. . There are no Reserves and they refuse to share the accurate budget to show where the money is going. They have a Mickey Mouse Security Guard company that are told by the office employee (2) ladies that work in the office at Mandarin Lakes to TOW CARS AWAY! There are rumors that they get kick backs from the Tow Company. These guards be sleeping most times, and they tow the cars they want. There are cars that park in the grass and they don’t get towed. The guards here are scare to tow certain people’s cars. The rules here don’t apply to everyone equally. The office personnel which one is called Fake Barbie by everyone in the community because she considers herself to know what she is doing, but she’s does not. Most of the HOA fee’s that we pay goes mostly to her income $75K a year. There are sidewalks that are cracked or broken. That is a hazards for someone that can be walking. There are times that some post lights don’t work so is super dark. We have told the guards about those post lights how is a hazardous and they say oh we already told them. Months go by and the lights are not fixed. The roof’s most of them are cracked due to a company the HOA hired to clean the roof tiles and most houses got their roof tiles cracked. There’s a lot of houses that now have leaks inside their home and the homeowner insurance won’t cover that. The HOA has no reserves so now we the homeowners have to pay to repair those tiles. Is so many things going that is crazy. We are so discussed with them and how things are being handled that we just want to sell and move out of Miami Dade. Many people bark but they don’t do anything about it. We were suppose to try to vote them out but a lot of homeowners got afraid and nothing changed. We should come together as a community but here some people are afraid to speak up. There was a meeting a few months ago and since we asked questions about the budget and they couldn’t respond to the questions the homeowners got upset. Yes, upset and guess what happened the office personnel called the police . It was all over the news. Is easy if you have nothing to hide then why the questions weren’t answered? Why call the police? Is to many things going on here that we don’t know about.

      New laws will bring a whole new level of accountability to your HOA. If they continue this behavior after today, you will have a line of attorneys at your door wanting to take your case.

      Most boards struggle to get people to volunteer for them at all. That is the problem, the people who live in these communities couldn't be bothered to deal with the governance, and then complain about the governance.

    Thank you for the good news you have provided to us, frustrated HOA homeowners. How do we fight HOA's in court w/out wasting a lot of money. In my community (Country Lane Estates, Williston, Florida 32696) the HOA is putting us on notice because the grass is not being kept super green. We complained because the type of grass the developer placed is not one approved by state law and I believe is not native to Florida. The other problem is that the City of Williston, Florida, 32696, Water Department refused to place a separate water meter for irrigation. Instead, they combined the Sewage charges (which are not only higher but grow exponentially after a certain point in the curve), They came up with that idea to make more revenue for the city, because Tallahassee told them to stop requesting state funds and come up with innovative ideas to get money from its citizens. My question: How do we get the city and the developers (Lennar Homes) to install a separate water meter for irrigation, at no cost to us, or replace all the grasses? Thank you for any help you can provide. HHR

      As for your issues with water, the developer is out of the picture now, it is up to your HOA board to take care of the problem. You are going to have to pay for it, no one else is going to pay for you.

    Keep a copy of the Statutes HANDY & find out the RULES they use to run their meetings (Usually "Robert's Rules of Order")! You might be surprised how that gets the "Board's" attention if you know your rights buried inside those rules!

    It's amazing how you could make this video so sexy. You did a good job! HOA's can be a pain in the butt. I'm by Clearwater beach. Fortunately, I don't live in an HOA. I have a really nice Grady White boat on the side of my house. It's always covered and backed in behind the front of my house. I also have a big Ford F-150 Supercab. I do keep it in the garage, but there may a be a time or two where I might leave it out in the driveway overnight. I keep my yard looking like a well manicured golf course. Gardening is a hobby of mine. I've found that the neighbors do try to keep up with the look. That's up to them. The neighborhood is just fine.

    The HOA should have all of their financial spending and intake from HOA dues... on their website for al home owners to view. And residents should have a right to complain about wasteful spending by the committee,

      There is a budget presented at the AGM, which can be approved or voted down. Just keep in mind though, if you don't have a budget the HOA will not be able to pay the bills and the entire property could potentially be sold off.

    HOA includes neighbors with strong opinions. So if my neighbor thinks cars should park on the grass, is that person oppressive, controlling, wrong? If the neighborhoods turn to horrible looking areas, then what? Do we just accept that we will all live in trashed neighborhoods instead of what we bought into, a beautifully, manicured area with beautiful wildlife? I don’t believe someone should lose their home, but how do we live together in a nice looking neighborhood? How is that achieved, what is the advice? Glad people will be happy, as long as they don’t care about taking care of property and neighborhood. Why even invest in a home anymore? Let’s all camp out, that should work.

      People still have to follow the rules, they just have to give them reasonable notice to comply and not over fine people... just some common sense practices.
